The Northern Sonoma County Air Pollution Control District has recently received complaints from residents of the Palomino Lakes Community regarding open’ burning practices in this area. Specifically, concerns have ‘been raised as to the type of material being burned and the hours during which burning has been conducted.

This letter is intended to convey information on proper burning procedures for residents of the Palomino Lakes Community. We would appreciate very much if your Association newsletter would provide this information to your members.

Under the rules and regulations of the District, ‘open burning may be used to dispose of approved combustibles (vegetative matter), on a permissive burn day, within designated burning hours and while in possession of a valid burn permit. Possession of a valid air quality burn permit is required at all times. Burn permit applications are available at this time of year from the Cloverdale Fire Department or at the offices of the Northern Sonoma County Air Pollution Control District located in Healdsburg at 1S0 Matheson Street.

The Districts policy is to strictly enforce violations of its rules and regulations up to and including civil or criminal prosecution as allowed by the California Health and Safety Code. Maximum penalties are $1,000 per violation and a maximum of 6 month imprisonment. Though such extremes are not typical. fines for open burn violations can easily be as high as several hundred dollars.

I urge your members to obtain the necessary burn permits if they do not already have one. Feel free to call me at 433-5911 with any questions you might have.

President’s Report:

President Lamb introduced Andy Grose as Supervisor of Elections. Association members were invited to observe as Mr. Grose then proceeded to open and count ballots at a table at the rear of the room
President Lamb discussed plans for this year’s road repairs. The roads came through the winter in pretty good shape and there is need for only a few minor repairs. The bulk of this year’s effort will go to seal coating. The seal coating done last year on Palomino dramatically improved both the water shedding performance of the roadway and its appearance.
President Lamb polled the audience regarding their desire to again have a community wide chipping program this summer. There was a strong desire that the program be continued. Jim will follow up.
Members were reminded that residents are required to trim flammable vegetation by July 1 and pointed out the requirement that vegetation within 10 feet of a roadway must be mowed. The Association will send out violation notices in the event of non-compliance.

Vice-President’s Report:

There no Vice-President’s report as Roger Shideler was called away on urgent business.

Treasurer’s Report:

Treasurer Corriea reviewed the Association’s 2012/2013 budget and presented the 2011/2012 financial statement. The Association is solvent, paying its bills and has an adequate contingency fund. Assessments will increase from $150 to $155 per quarter beginning July 1, 2012.
Cloverdale Fire contacted us about the gate on upper Palomino Road. They have the combination to the lock on the gate but are urging people to replace private locks with an approved “Knox” lock. These locks are keyed alike, only the department has a key and they eliminate the need for the department to maintain lists of private lock combinations. The lock has been ordered.

Election Results:

Supervisor of Elections Grose announced the results of the election:
The No Soliciting sign question resulted in 37 “Yes” votes and 25 “No” votes
Rick Corriea, Jim Lamb, and Roger Shideler were elected.

After numerous notices, lot# 117-290-006-000 is now delinquent in both the October 1, 2010 and January 1, 2011 assessments. The Board reviewed and passed a resolution to forward the account to Pro Solutions for collection.

Special Meeting to discuss proposed restriction of ‘vacation rentals’:

The board voted not to present the proposal to the membership for a vote. Lamb “No”, Corriea “No”, Decaminada absent.
The board issued the following statement,

“Thank you to all who attended Saturday’s meeting and to those who emailed and contacted members of the board about vacation rentals. Your input was very helpful and appreciated.

The deliberations of the board were made much easier when, the day after we mailed copies of the vacation rental proposal, the Sonoma County Board of Supervisors adopted its long delayed ordinance on vacation rentals. This ordinance, while not perfect, addressed many of the concerns expressed by those of you who wanted reasonable controls placed on vacation rentals while at the same time providing for those who were concerned about maintaining flexibility in the use of their property. There was broad support for the vacation rental ordinance expressed at the meeting.

The owners of two of the properties offered as vacation rentals have already committed to adhering to the terms of the ordinance. The board will contact the owners of a third property to discuss the ordinance and relay the community views expressed at the meeting.

The members of the board and most if not all of those present at the meeting felt that the county ordinance is the preferred method for dealing with this issue. Accordingly, the board voted not to submit the CC & R proposal for a membership vote.”

President’s Report:

President Lamb introduced Andy Grose as Supervisor of Elections. Association members were invited to observe as Mr. Grose then proceeded to open and count ballots at a table to one side of the room
President Lamb introduced Captain Terry Morgan and several firefighters from the Cloverdale Cal Fire station. Captain Morgan outlined Cal Fire’s ongoing prevention, inspection and enforcement efforts. Captain Morgan reported that all properties in Palomino Lakes were inspected in the last few weeks and notices left on all homes. Those homes where inspection revealed the need for corrective action will be re-inspected within the next few weeks. Properties will be cited if homeowners have ignored previous notices.
Captain Morgan also noted that Sonoma County’s ongoing chipper program is again available and urged residents to take advantage of the program. Individual property owners may contact Rick Blackman at Cloverdale Fire, 894-3545, to discuss chipping on individual properties. The Association will also try to put together another community-wide chipping program. Volunteers will be needed to work with the fire department chipper crew.
President Lamb reviewed Association activities for the past year. Road repairs were completed on Palomino and Mountain Pine roads and tree trimming and vegetation trimming was completed throughout the community. The culverts which cross under the roads were inspected and many required cleaning and repair – several were completely plugged. The culverts performed as designed in this year’s heavy rains.
The President also outlined the road repair campaign for this year. A number of areas on Palomino Road are in need of repair and a contract for approximately $35,000 has been signed with Oak Grove Construction. Work will take place in early June. Several residents volunteered to help with traffic control, more volunteers are need.

Vice-President’s Report:

Vice-President Decaminada reported that property on River Road, South of Crocker Road, has recently sold and the new owners are operating a junk yard and metal recycling facility. This activity is unpermitted and in violation of County regulations. The Association will file a complaint with the county. Residents are also urged to make complaint with Sonoma County Code Enforcement, 565-3717, as the county generally responds more quickly if it receives numerous complaints.

Treasurer’s Report:

Treasurer Corriea reviewed the Association’s 2010/2011 budget and presented the 2009/2010 financial statement. The Association is solvent, paying its bills and has an adequate contingency fund. Assessments will remain the same for the 2010/2011 year. The Association was forced to write off $350 in uncollectible debts and has so far been unable to collect about $500 because of homeowner bankruptcy and a foreclosure.

Election Results:

Supervisor of Elections Grose announced the results of the election:
The Fire Prevention proposal passed 51 votes to 30 votes (62% to 38%).
Rick Corriea, Randy DeCaminada and Jim Lamb were elected.

President’s Report:

President Lamb introduced Andy Grose as Supervisor of Elections. Association members were invited to observe as Mr. Grose then proceeded to open and count ballots at a table to one side of the room
President Lamb reviewed Association activities for the past year. Road repairs were completed on Palomino and Mountain Pine roads and tree trimming and vegetation trimming was completed throughout the community. The Board worked with homeowners and the county to address issues of aggressive dogs and dogs running loose. The county responded to Palomino Lakes on three occasions and the results have been very positive.
The President also outlined the road repair campaign for this year. Lower Mountain Pine Road has a seriously deteriorating area of approximately 2,500 sq. ft. that has to be addressed. In addition, several smaller areas on Palomino Road are scheduled for repair. Bids are being solicited.
President Lamb also discussed the problems with the culvert/drainage ditch on Madrone Drive at Palomino Road. This area needs to be graded, the ditch cleaned out, and rip-rap installed. Bids are being solicited.
President Lamb also reviewed a handout containing an email from the Association attorney, Barbara Zimmerman, and her proposed CC&R amendment requiring residents to comply with state and county fire prevention regulations. A brief discussion followed with attendees being generally supporting of the proposal. The proposal will be finalized and submitted to Association members for a secret ballot vote.

Treasurer’s Report:

Treasurer Corriea reviewed the Association’s 2009/2010 budget and presented the 2008/2009 financial statement. The Association is solvent, paying its bills and has built a small contingency fund. The Association was forced to write off $2,200 in uncollectible debts resulting from a homeowner bankruptcy and a foreclosure.
Treasurer Corriea also pointed out that this year’s road repair campaign will require a short term loan from the water company. The water company has provided 60 day loans in advance of the Association’s October 1 assessment and in 2007 and 2008 and their help is greatly appreciated.
Treasurer Corriea also noted that the Association has contracted with Pro Solutions, a professional collection agency, to collect seriously delinquent accounts. To date, one homeowner has been referred to Pro Solutions. Accounts are referred to Pro Solutions only after repeated collections attempts fail.

Guest Speaker:

President Lamb presented Brian Elliott, Chief of the Cloverdale Fire Protection District.
Chief Elliott was accompanied by two fire fighters from CFPD and by Captain Terry Morgan of the California Department of Forestry and Fire Protection (Cal Fire) and four Cal Fire fire fighters.
Chief Elliott discussed the state of fire prevention and fire fighting throughout California. Fire fighting resources are stretched thin and homeowners need to partner with fire fighting organizations if maximum fire prevention and minimum fire loss is to be realized.
Chief Elliott presented a video review of the current state of fire prevention efforts in Palomino Lakes. Through photographs taken the week before the meeting, the Chief showed examples of good fire prevention efforts and also showed homes that would present serious challenges to fire fighters in the event of a wild fire. The message: Where homeowners take an active role in following state and county regulations, fire fighters have a much better chance of saving their homes. Chief Elliott repeatedly mentioned Toyon Lane as an area of special concern with its steep slopes and high fuel load.
Chief Elliott provided a number of handouts including “Living With Fire in Sonoma County”, a pamphlet that he suggests all homeowners should have, understand and follow.
The Chief also noted that there is now a wood chipper and operator available through Fire Safe Sonoma. President Lamb will coordinate with CFPD to try to get the chipper scheduled for Palomino Lakes.
Chief Elliott and Captain Morgan and their fire fighters graciously agreed to remain during the break between the Association and Mutual Water Company meetings to answer individual questions from homeowners.

Delinquency Collection Policy. The proposed policy was introduced and discussed. The Board then voted on the proposal. Lamb, Aye; Corriea, Aye; Forchini, Absent.
CC&Rs changes. There were extensive discussions regarding proposal to change the CC&Rs. It was ultimately decided that the Board would meet with the Association attorney to discuss potential changes and to develop various proposals to deal with dogs, fire prevention, and quiet enjoyment. These proposals, along with attorney recommendations, would be presented to the members in the form of a straw poll which would be used to determine if the community wishes to proceed with amends and the form of any such amendment.
Gun Fire. There have been reports of gunfire on or near Cedar Lane. This is a violation of the law and residents are urged to call the sheriff and then report the outcome to the Association.

1088 Palomino Road: This property has changed hands due to foreclosure. The Board has been in contact with the new owners and their representatives and will work enthusiastically with them to correct problems with this property.
Overdue Assessments: The board decided to send demands and notice of proposed legal action to three property owners who are far behind in paying their assessments.
Assessment collection and lien enforcement: The Board reviewed the proposed policy and voted to mail the proposal to members and scheduled a vote on the proposal for the next meeting. Lamb – Aye, Forchini – Aye, Corriea – Aye

2008 Budget: Reviewed and debated 2008 budget proposal. Agreed that roads remain the #1 priority with an estimated backlog of $30K to $35K. Also agreed to establish a contingency fund with a goal of $15K to $20K collected over three or four years. Finalized and adopted the 2008 budget which will be mailed to members prior to March 1. Regular Meetings: The Board is concerned that state laws require open meetings but PLPOA meetings are typically held in the home of one of the Board members. Should more than a few members wish to attend a meeting the result can be very inconvenient for the directors and their families. The Board will look at ways to inexpensively hold meetings in a public place.
